Foreign Office to Board of Trade.
Foreign Office, May 12, 1905. WITH reference to previous correspondence relative to the Provisional Regulations governing the registration of trade-marks in China, I am directed by the Marquess of Lausdowne to transmit to you herewith, for the consideration of the Board of Trade, a copy of a despatch from His Majesty's Minister at Peking, forwarding the proposals drawn up by the "Deutsche Vereinigung" of Shanghae for the amendment of the Regulations. The proposals embody the various suggestions from time to time put forward by the mercantile community of that port on the subject.
Sir E. Satow points out that the salient feature of these proposals is Article 26, which deals with the treatment of marks, registered and unregistered, in public use in China prior to the signature of the Treaty between Great Britain and China of 1902.
Sir E. Satow goes on to say that he considers Article 26 to be a practical solution of the difficulty with regard to these marks.
I am to inquire whether the Board concur in Sir E. Satow's opinion as to the satisfactory character of the Article in question.
